The good news is that with the right information there are many of the problem areas that you can handle yourself. The other good news is that we have built into this guide as many of the lessons we have learned about how to get to the right outcome as we can.
We are basically sharing everything we can think to write down from the brains of our lawyers with combined decades of experience in all things employment law, including unemployment applications and appeals. Your Unemployment Options
Do It Yourself
You can navigate this process without spending any money, by following the instructions in your UI online account.
If your situation is straightforward, this might be the option for you. For example, if you have been laid off and your employer is not contesting your unemployment benefits, you may not need any help. Many people, however, run into difficulties answering the initial questions in a way that maximizes their chances for a quick approval. You can often overturn a denial on appeal, but it can take time and delay your receipt of benefits while you are looking for other work. There are also special situations- for example a notice of overpayment from the DUA, or a need to file a late appeal, or a claim by your employer that you were terminated for a disqualifying reason- that many people find difficult to handle 100% on their own. |
Hire an Attorney
An attorney experienced in unemployment can help you get it right the first time without prolonged appeals. An attorney can also be invaluable in helping you at an appeal hearing.
For most people, this does not make economic sense before you have an appeal hearing scheduled. Most of the things you need to do at this stage do not require the professional expertise of a lawyer, and the time it would take for an attorney to help you with these steps at regular attorney rates would be cost-prohibitive. If you are at a stage where you need an attorney (for example, you have a scheduled hearing, or you have an appeal denial that you need to submit for further review, or your employer is actively contesting your right to benefits), we are happy to help- contact us for more information. |
Start With the Roadmap
The Unemployment Road Map is a step by step guide through the unemployment process, from preparing your application through the appeals steps.
The Roadmap is available for a one-time charge of $38.50, and you can use it for as long as you like without any renewal or subscription fees. You will also have access to our private facebook group, where you can ask us questions or share your experiences with others going through the same thing. You can use it as a guide to do it yourself from beginning to end. We have include information about the whole process, as well as guidance for specific legal issues that often come up. If you get to a point where you are ready for legal help, all you have to do is give us a call- if we can help you, anything you have paid for the Roadmap will be deducted from your legal fees. |
Unemployment is such an important part of the safety net for people who find themselves between jobs, and we are happy to help where we can. Many times, however, we are fighting an uphill battle because people did not have all the right information when they first applied for benefits. Also, there are some parts of the process where it simply does not make sense to pay lawyers to intervene- again, we have come to believe that if people had the right information, they could take care of many aspects of the process without dipping into their benefits to pay a lawyer.
So we developed the roadmap, to give a low cost resource to all people seeking to receive benefits, or to challenge a claim of overpayment. We have noted in the roadmap the places in the process where it makes sense to hire a lawyer, but still tried to give you what you need to know if you decide to represent yourself. Want a preview?
